My Atelier – Terms of Use
Last updated: 17 October 2026 Effective from: 17 October 2026
Summary
This summary gives you the most important points in plain language. The full Terms below apply.
- My Atelier is an online marketplace that connects clients with independent fashion designers. Designers sell their own pieces and create custom designs. My Atelier is not the seller.
- You must be at least 18 years old to create an account. Anyone can browse without an account.
- Designers must apply and be approved before they can sell or accept commissions.
- Clients pay through My Atelier. My Atelier holds the payment and pays the designer after the 7-day complaint window has ended, minus a 10% commission. Clients pay no platform fee.
- For made-to-measure pieces, the measurements confirmed by the client before production are part of the agreement. Designers document the finished piece before shipping. If a piece does not match the agreed measurements, the designer first gets the chance to alter it.
- Problems can be reported within 7 days of delivery through "Request a return / report a problem". My Atelier reviews the evidence and decides. Your statutory consumer rights remain unaffected.
- Payments, communication and agreements should stay on My Atelier. Off-platform deals are not allowed.
- You keep the rights to everything you upload. You give My Atelier a licence to display it on the platform and to promote it.
- Swedish law applies. If you are a consumer, you keep the mandatory protection of the country where you live.

3. Accepting and changing these Terms
3.1 By creating an Account or using the Platform, you agree to these Terms. If you do not agree, you may not use the Platform.
3.2 We may change these Terms, for example because of new features, legal requirements or changes to our business. We will inform you of significant changes by email or in the Platform before they take effect.
3.3 For Designers, changes take effect no earlier than 15 days after notification, unless a shorter period is required by law or is necessary to address an unforeseen and imminent danger related to fraud, malware, spam, data breaches or other security risks. A Designer who does not accept a change may terminate their Account before the change takes effect.
3.4 Changes do not apply retroactively to Orders or Commissions concluded before the change took effect.
4. Eligibility and Accounts
4.1 You must be at least 18 years old to create an Account, buy Pieces, post Custom Designs, commission Designers or sell on the Platform. Anyone may browse public parts of the Platform without an Account.
4.2 You must provide accurate and complete information and keep it up to date. You may only have one Account, unless we have approved otherwise.
4.3 You are responsible for keeping your login details confidential and for all activity in your Account. Tell us immediately at info@myatelier.app if you suspect unauthorised access.
4.4 When creating an Account, you choose whether you join as a Client or as a Designer. Designer accounts have Client access until the application has been approved (see section 6).
4.5 You can delete your Account at any time in Settings. Section 17 describes what happens to open Orders, Commissions and Content when an Account is deleted.
5. My Atelier's role
5.1 My Atelier provides an online marketplace. Contracts for the sale of Pieces and for Commissions are concluded directly between the Client and the Designer. My Atelier is not a party to these contracts and is not the seller, manufacturer or agent of any Piece.
5.2 Each Designer is responsible for their Listings, Proposals and Pieces, including their quality, safety, legality, description and delivery.
5.3 My Atelier collects payments from Clients on behalf of the Designer (see section 7). When a Client has paid My Atelier, the Client's payment obligation towards the Designer is fulfilled.
5.4 Each Designer profile shows whether the Designer sells as a Trader or as a private person. Consumer rights under EU and Swedish consumer law, such as the right of withdrawal, generally apply only when buying from a Trader.
5.5 Some content on the Platform is clearly marked as sample content, for example illustrative designers, pieces, requests and articles. Sample content shows how the Platform works. Sample designers cannot be contacted, and sample pieces cannot be bought.
5.6 We work to keep the Platform available and secure, but we cannot guarantee uninterrupted or error-free operation. We may change, add or remove features.
6. Designers
6.1 Application and approval
6.1.1 To sell or accept Commissions, you must apply as a Designer. The application includes information about your experience, a CV, photos of your own work and optional links.
6.1.2 My Atelier reviews applications and may approve, reject or request more information. Approved Designers receive a verification badge. We may reject an application without detailed reasons, except where the law requires us to give reasons.
6.1.3 Application documents are stored privately and are only used for the review.
6.2 Designer obligations
As a Designer, you agree to:
- (a) only offer Pieces that you have designed or made yourself, or that you have the right to sell;
- (b) describe your Pieces accurately and completely, including materials, measurements, sizing, production time, delivery destinations, care instructions, returns policy and any alteration options;
- (c) only make sustainability, ethical or origin claims that are true and that you can substantiate. Each claim must include the explanation required by the Platform;
- (d) state correctly whether you sell as a Trader or as a private person and update this if it changes;
- (e) comply with all laws that apply to you, including consumer law, product safety, textile labelling, tax and accounting rules;
- (f) fulfil Orders and Commissions as agreed, ship on time and respond to Clients within a reasonable time;
- (g) only use Clients' personal data, including measurements and addresses, to fulfil the relevant Order or Commission;
- (h) not offer counterfeit items or items that infringe the rights of others.
6.3 Traders
If you sell as a Trader, you are responsible for providing Clients with the information required by consumer law, honouring the statutory right of withdrawal where it applies (see section 8.4), and handling complaints about faulty goods in accordance with applicable law.
6.4 Collaborations
A Designer can invite other approved Designers to collaborate on a Commission. The Designer who submitted the Proposal ("Lead Designer") remains responsible towards the Client for the entire Commission. Payment is made to the Lead Designer, who is responsible for any arrangements with collaborating Designers.
6.5 Taxes and reporting
Designers are responsible for their own taxes, including VAT and income tax. Under EU and Swedish law (DAC7), My Atelier may be required to collect information about Designers, such as name, address, tax identification number and income from sales, and to report it to the Swedish Tax Agency (Skatteverket). Designers must provide this information on request. We may suspend payouts until the required information has been provided.
7. Fees, payments and payouts
7.1 For Clients, using the Platform is free. Shipping is free for Clients. The total price, including any applicable taxes, is shown before you complete your purchase; no shipping charge is added.
7.2 For Designers, My Atelier charges a commission of 10% of the price of each sold Piece or Commission, excluding shipping costs. The commission is deducted from the payout. We will inform Designers in advance of any change to the commission in accordance with section 3.3.
7.3 Payments are processed by our payment provider Stripe. Payment card details are handled by Stripe and are not stored by My Atelier.
7.4 My Atelier holds the payment until:
- (a) 7 days have passed since the Client received the Piece without a complaint being submitted (see section 12); or
- (b) an open case has been resolved.
The amount due to the Designer is paid out seven days after the Client receives the Piece, provided no complaint has been submitted. If a complaint is submitted before payout, the payment remains on hold until the case is resolved and is then paid out or refunded in accordance with the decision. The payout is made to the bank account provided by the Designer, minus the commission, any refunds and any actual Shippo label costs. The time it takes for the funds to reach the bank account depends on Stripe and the receiving bank.
7.5 If a payment is refunded or reversed (for example a chargeback), the corresponding amount, including any commission already deducted, may be deducted from the Designer's future payouts or claimed back from the Designer, unless the refund was caused by an error on our part.
7.6 Payments, deposits and price agreements for Pieces and Commissions found on the Platform must be made through the Platform. Asking for or accepting payment outside the Platform is not allowed (see section 15).
8. Buying ready-made Pieces
8.1 Each Listing shows the price, materials, size and measurements, delivery destinations and the Designer's returns policy. Read these before you buy.
8.2 A purchase contract between the Client and the Designer is concluded when the Client has completed payment. You will receive an order confirmation by email and in the Platform.
8.3 The Designer must ship the Piece within the production or dispatch time stated in the Listing.
8.4 Right of withdrawal. If you are a consumer and buy from a Trader, you have the right to withdraw from the purchase within 14 days of receiving the Piece without giving a reason. This does not apply to Pieces made to your specifications or clearly personalised, such as made-to-measure and custom-made Pieces. To withdraw, use "Request a return / report a problem" in your order or contact the Designer. You must return the Piece within 14 days of withdrawing, unused and in the condition received, apart from what is needed to examine it. The Designer will refund the price, including standard delivery costs, within 14 days of receiving your withdrawal notice, but may withhold the refund until the Piece has been returned or you have provided proof of return. Unless the Designer has stated otherwise, you pay the cost of returning the Piece.
8.5 Designers may offer additional, more generous return options in their returns policy. These are voluntary and are set out in the Listing.
8.6 When you buy from a private person, the statutory right of withdrawal does not apply. The Designer's returns policy and section 12 apply.
9. Custom Designs and Commissions
9.1 Posting a Custom Design
A Client can post a Custom Design describing the requested piece, including category, budget, deadline, inspiration images and, where needed, measurements. Measurements are visible only to the Client and to the Designer who is hired for the Commission.
9.2 Proposals
Designers can submit a Proposal. A Proposal must state at least the price, delivery time, materials, number of included revisions and, for made-to-measure work, the measurement tolerance (for example ±1.5 cm).
9.3 Concluding a Commission
A Commission is concluded when the Client has accepted a Proposal, the Designer has confirmed the agreement, and the Client has paid the full price. The accepted Proposal, the confirmed measurements and any written agreements made in the Platform's messages together form the agreement between the Client and the Designer.
9.4 Payment
The Client pays the full price when the Commission is concluded. My Atelier holds the payment in accordance with section 7.4.
9.5 Measurement confirmation
Before production starts, the Client must confirm their measurements in the Commission timeline. The Client is responsible for the accuracy of the measurements they provide and confirm. A Designer may also offer a fitting, for example by video call, during production.
9.6 Revisions and changes
Revisions are included as stated in the Proposal. Changes beyond the agreement, such as new measurements after confirmation or a different design, require the Designer's consent and may lead to an adjusted price or delivery time, which must be agreed through the Platform.
9.7 Cancellation
- (a) Before the Client has confirmed the measurements (or, for Pieces without measurements, before production has started), the Client can cancel the Commission and receive a full refund.
- (b) After production has started, the Commission cannot be cancelled by the Client, as the Piece is made to the Client's specifications. This does not affect the Client's rights under section 9.8 or section 12.
- (c) If the Designer cancels the Commission or cannot complete it, the Client receives a full refund.
9.8 Delays
If the Designer does not deliver within the agreed delivery time and has not agreed an extension with the Client through the Platform, the Client may set a reasonable additional deadline of at least 14 days. If the Piece has not been shipped by the end of that period, the Client may cancel the Commission and receive a full refund.
9.9 Rights to designs
Unless otherwise agreed in writing through the Platform:
- (a) the Designer keeps all copyright and other rights to their designs, sketches and patterns;
- (b) the Client becomes the owner of the physical Piece and may use, wear, show and resell it;
- (c) the Client may not reproduce or have the design reproduced;
- (d) the Client keeps the rights to their inspiration images and grants the Designer the right to use them only for the Commission.
The Designer may show photos of the finished Piece in their portfolio, unless the Client has asked otherwise before the Commission was concluded.
10. Measurements, sizing and the Creative Studio
10.1 For made-to-measure Pieces, the measurements confirmed by the Client under section 9.5 and the tolerance stated in the Proposal are part of the agreement.
10.2 Before shipping a made-to-measure Piece, the Designer must upload photos of the finished Piece showing it measured with a measuring tape at the key points (such as bust, waist, hips and length). The Piece cannot be marked as shipped without this documentation.
10.3 Designers may attach a removable fit tag to made-to-measure and custom Pieces. Clients should keep the tag attached until they have tried the Piece on and are satisfied with the fit.
10.4 The silhouette in the Creative Studio is a proportional illustration based on entered measurements. It is not a calibrated pattern and does not guarantee fit.
11. Shipping and delivery
11.1 Shipping is free for Clients. The Designer is responsible for arranging, packing and shipping the Piece to the address stated in the Order. Designers may purchase shipping labels through the Platform using Shippo or arrange shipping directly. Actual Shippo label costs are deducted from the Designer’s payout balance and are not charged to the Client. Creating or purchasing a label does not establish that the Piece has been handed to the carrier.
11.2 The Designer must provide tracking information where available.
11.3 For consumers, the risk of loss or damage passes to the Client when the Client, or a person indicated by the Client, receives the Piece.
11.4 For deliveries outside the EU, customs duties, import taxes and fees may apply. The Listing or Proposal states who pays them. If nothing is stated, they are paid by the Client.
12. Problems, returns and disputes
12.1 Reporting a problem
If a Piece has not arrived, is damaged, is significantly different from its description or, for made-to-measure Pieces, does not match the agreed measurements within the stated tolerance, the Client can open a case using "Request a return / report a problem" in the order within 7 days of delivery. If the Piece has not arrived, the case can be opened from the expected delivery date.
12.2 Evidence
The Client must describe the problem and provide evidence, such as photos of the Piece and, for size issues, photos of the Piece measured with a measuring tape at the relevant points. The Designer has 5 days to respond and provide their own evidence.
12.3 Review by My Atelier
My Atelier reviews the case based on the Listing or accepted Proposal, the confirmed measurements, the Designer's pre-shipment documentation, the Client's evidence and the messages on the Platform. We aim to decide within 14 days of the case being opened, and we inform both parties of the decision and the reasons for it.
12.4 Possible outcomes
- (a) The Piece does not match the agreement, for example the measurements are outside the agreed tolerance: the Designer first has the opportunity to alter or remake the Piece at their own cost within a reasonable time. If this is not possible, is refused or fails, the Client receives a full or partial refund, as decided by My Atelier, after returning the Piece if requested.
- (b) The Piece matches the agreement, for example the measurements are within the tolerance or match the measurements confirmed by the Client: the case is closed without a refund. The Designer may offer a paid alteration.
- (c) The case cannot be clearly decided: My Atelier may propose a compromise, such as an alteration or a partial refund.
- (d) The Piece did not arrive and the Designer cannot show delivery with tracking: the Client receives a full refund.
12.5 Returns as part of a case
If a return is required, the Client must return the Piece with tracked shipping within 14 days of the decision. The refund is paid once the Designer has received the Piece and documented its condition with photos, or after 7 days if the Designer does not respond.
12.6 Worn or used Pieces
A size or fit complaint will not be accepted if the Piece shows signs of wear beyond trying it on, such as removed fit tags, makeup, perfume, washing, alterations by third parties or damage caused after delivery.
12.7 Payout during a case
While a case is open, the payment for the relevant Order remains on hold. After the decision, it is paid out or refunded in accordance with the decision.
12.8 Misuse
Making false claims, returning a different item, or repeatedly opening unjustified cases may lead to cases being rejected and to suspension of the Account (see section 17).
12.9 Your statutory rights
The case process in this section is a service offered by My Atelier. It does not limit your statutory rights. If you are a consumer and have bought from a Trader, you have the rights provided by consumer law against the Trader, including the right to complain about faulty goods. Under Swedish law, a complaint about a fault can be made within three years of receipt, and a complaint made within two months of discovering the fault is always considered to have been made in time. You can exercise these rights directly against the Designer even after the 7-day period, and we will help you contact the Designer.
13. Messages, video calls and bookings
13.1 Messages, video calls and bookings are provided so that Clients and Designers can discuss Pieces, Custom Designs and Commissions. Use them respectfully and only for these purposes.
13.2 You may not record video calls or share screenshots of private conversations without the consent of all participants, except as evidence in a case with My Atelier.
13.3 Bookings are confirmed when the Designer accepts them. Both parties can cancel a booking. Please cancel as early as possible.
13.4 We do not routinely read private messages. We may review messages when a conversation is reported, when needed to resolve a case under section 12, to prevent fraud or abuse, or when required by law. The Privacy Policy explains this in more detail.
14. Your Content
14.1 You keep the rights to the Content you upload.
14.2 By uploading Content, you grant My Atelier a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt (for example resize or crop), display and distribute it in order to operate, improve and promote the Platform, including in our social media channels, newsletters and marketing. The licence ends when you delete the Content or your Account, except for copies needed for legal reasons, to resolve disputes or that others have already shared within the Platform. Private messages, measurements and application documents are never used for promotion.
14.3 You are responsible for your Content and confirm that you have the necessary rights to it, including the consent of any person shown in it.
14.4 Stories are visible for 24 hours.
14.5 Reviews must be honest and based on a real Order or Commission. Offering or accepting anything in return for a review, writing reviews of your own Pieces, or reviewing a competitor is not allowed. We may remove reviews that break these Terms.
15. Prohibited conduct and content
You may not use the Platform to:
- (a) post, sell or promote anything illegal, counterfeit, stolen or dangerous;
- (b) infringe intellectual property rights, including copying other designers' designs, photos or texts;
- (c) harass, threaten, bully, discriminate against or abuse others, or post hateful, violent, sexual or otherwise offensive content;
- (d) mislead others, including through false descriptions, fake sustainability claims, fake reviews or impersonating another person or brand;
- (e) arrange payments or transactions outside the Platform for Pieces, Custom Designs or Commissions found on the Platform;
- (f) send spam, chain messages or unsolicited advertising;
- (g) collect other users' personal data or use automated tools to access the Platform (scraping), except with our written permission;
- (h) interfere with the security or functioning of the Platform, or try to bypass any restriction;
- (i) create multiple or fake Accounts, or use another person's Account;
- (j) use another user's measurements, photos or personal data for any purpose other than the relevant Order or Commission.
Zero tolerance: content that sexualises minors, promotes violence or terrorism, or constitutes hate speech will be removed immediately and the Account will be permanently closed. Where required, we report such content to the authorities.
16. Reporting, moderation and complaints
16.1 Reporting. You can report Content, profiles, conversations or Listings that you believe are illegal or break these Terms using the report function in the Platform or by email to info@myatelier.app. Please explain why, and include the location of the Content and your contact details where possible.
16.2 How we moderate. We review reports and may also review Content on our own initiative. Decisions are made by people. We may remove or restrict Content, limit features, hold payouts, or suspend or close Accounts. We act objectively, carefully and proportionately, taking into account the rights and interests of all parties.
16.3 Statement of reasons. If we restrict your Content or Account, we will tell you what we did, why, which rule or law it is based on, and how you can challenge the decision, unless the law prevents us from doing so.
16.4 Complaints. You can challenge a moderation decision, or our decision not to act on your report, within 6 months by replying to our notification or emailing info@myatelier.app. A person who was not involved in the original decision will review your complaint, and we will tell you the outcome without undue delay.
16.5 Out-of-court dispute settlement. If you are not satisfied, you can turn to a certified out-of-court dispute settlement body under the EU Digital Services Act, or go to court.
16.6 How content is displayed. The order in which designers, Pieces and Custom Designs are shown depends on, among other things: your search terms and filters (category, size, location and radius, budget, sustainability features); distance from your chosen location; how recently something was posted; whether you follow a Designer; engagement such as likes, saves and followers; ratings; and completeness of the profile. Sample content is shown when there is too little real content. My Atelier does not currently offer paid placement. You can change how content is shown by using the filters and the list or map view.
17. Suspension and termination
17.1 By you. You can delete your Account at any time in Settings. Open Orders and Commissions must be completed or cancelled in accordance with these Terms before the deletion takes full effect. Designers will receive any outstanding payouts.
17.2 By us. We may suspend or close an Account, limit features or hold payouts if you seriously or repeatedly break these Terms or the law, if we have reasonable grounds to suspect fraud or misuse, or if required by law. We will inform you as described in section 16.3.
17.3 Designers. If we decide to terminate a Designer's Account entirely for reasons other than a serious breach, legal requirement or imminent risk, we will give at least 30 days' notice with reasons.
17.4 Sections that by their nature should continue after termination, including sections 7.5, 9.9, 12, 14.2 (for copies retained under that section), 18 and 20, continue to apply.
18. Liability
18.1 My Atelier is responsible for providing the Platform in accordance with these Terms and applicable law. The Designer is responsible for the Pieces and Commissions they offer, and for fulfilling the contracts concluded with Clients.
18.2 Except as set out in section 18.3, My Atelier is not liable for indirect loss, such as lost profit, lost data or loss resulting from contracts between users, and our total liability towards a Designer is limited to the commission paid by that Designer in the 12 months before the event giving rise to the claim.
18.3 Nothing in these Terms limits liability for intent or gross negligence, for personal injury, or any liability that cannot be limited under mandatory law, including the rights of consumers.
18.4 We are not responsible for delays or failures caused by circumstances beyond our reasonable control, such as natural disasters, war, strikes, power or internet outages, or failures by payment, hosting or shipping providers (force majeure).
19. Privacy
19.1 Our Privacy Policy explains how we process personal data: Privacy Policy.
19.2 When a Designer receives a Client's personal data (such as name, address and measurements) to fulfil an Order or Commission, the Designer processes this data as an independent controller and must comply with data protection law.
19.3 Measurements are visible only to the Client and to the Designer hired for the relevant Commission.
20. Applicable law and disputes
20.1 These Terms are governed by Swedish law. If you are a consumer living in another country, you keep the protection of the mandatory provisions of the law of that country.
20.2 If you have a complaint about My Atelier, please contact us first at info@myatelier.app. We will try to find a solution together.
20.3 Consumers living in Sweden or another EU/EEA country can turn to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), Box 174, 101 23 Stockholm, www.arn.se, regarding disputes with My Atelier. We will participate in proceedings before ARN.
20.4 Disputes are decided by Swedish courts. Consumers may also bring a claim in the courts of the country where they live.
21. Language
These Terms are written in English. Translations into German, Spanish, French and Swedish are provided for information. If there are differences between the versions, the English version applies, unless mandatory law requires otherwise.
22. Other provisions
22.1 If any provision of these Terms is found to be invalid, the remaining provisions continue to apply.
22.2 If we do not enforce a provision immediately, this does not mean that we waive our right to do so later.
22.3 We may transfer our rights and obligations under these Terms to another company, for example if My Atelier becomes a limited company (aktiebolag). We will inform you in advance, and this will not reduce your rights.
22.4 You may not transfer your rights or obligations under these Terms without our written consent.
22.5 These Terms, the Privacy Policy and the agreements concluded between users on the Platform make up the entire agreement regarding your use of the Platform.
